MEDIATION & DISPUTE RESOLUTION

Mediation is a constructive and cost‑effective way to resolve family law issues without going to court. It allows both parties to work toward practical, mutually acceptable solutions in a guided and respectful environment.


We help you prepare by clarifying your goals, understanding your rights, and identifying the options that may work best for your situation and the level of support that suits you:

  • Behind‑the‑scenes guidance, where we prepare you thoroughly and remain available to advise you during the process, or
  • Full representation at the mediation, where we attend with you to advocate, negotiate, and ensure your interests are protected.


Whether your focus is parenting, property, or both, mediation often leads to faster, more flexible and more cost-effective outcomes.

COLLABORATIVE LAW

Collaborative law offers separating couples a respectful, solutions‑focused alternative to court. Through a structured process, supported by both parties’ lawyers and other appropriate professionals, you work together to reach a fair settlement without litigation. 


The process is voluntary and guided by a participation agreement, which commits everyone involved to resolving matters cooperatively. Collaborative law promotes open communication, privacy, and outcomes tailored to your family’s unique needs.

FAQS

A facilitated negotiation process aimed at helping parties reach agreement on parenting, child support or financial issues.


  -  Yes, for parenting matters unless an exemption applies. 

 -    Financial matters require pre-action procedure steps to be satisfied before filing an Application.


Agreements can be formalised via Consent Orders, Parenting Plan, BCSA, Financial Agreement.


A section 60I certificate can be issued without mediation, allowing you to apply to the Court.


For parenting: schedules and notes. 


For property: full financial disclosure as required under pre‑action procedures.


A process where both parties and lawyers commit to resolving matters without court.


Suitable for parties willing to negotiate respectfully.


Both collaborative lawyers must withdraw and new lawyers must be appointed for litigation.
